California Man Shot in Face By Alleged Burglar Sued for Shooting Back

Ninety-year-old Jay Leone of Greenbrae, California was shot in his jaw when an armed burglar came into his home Jan 3rd.

Leone says that Samuel Cutrufelli knocked down the door of his home and held him at gun point while rummaging around his home for valuables.

when Leone finally managed to convince Cutrufelli to let him use the restroom he emerged with his own weapon, a .357 revolver.

Cutrufelli panicked when he saw the gun, that Leone kept for self defense, and shot him in the head.

Before Leone could fire back Cutrufelli reportedly begged for mercy claiming that he had a daughter.

Leone shot his gun at the intruder 3 times before Cutrufelli grabbed the gun from Leone’s hands and placed it on the elderly man’s temple.

He pulled the trigger but the gun was out of bullets.

Cutrufelli is now suing Leone for ”great bodily injury, and other financial damage, including loss of Mr. Cutrufelli’s home, and also the dissolution of Mr. Cutrufelli’s marriage.”

Leone, however, claims he will counter sue.

both men recieved medical treatment and are now awaiting Cutrufelli’s trial.
